Biancalani is pleased to announce that the lawsuit brought against the Chinese textile machinery manufacturer Jiangyin Yuefa Printing and Dyeing Machinery Co., Ltd. (Refatech) has resulted in a favorable outcome at first instance.
The Supreme People’s Court of Wuxi, applying the Patent Law of the People’s Republic of China, fully upheld Biancalani’s claims and found that Refatech infringed two Chinese patents protecting Biancalani Textile Machinery’s AQUARIA® technology, namely both the method patent and the machine + method patent.
The Court ordered, in the first instance:
- Immediate cessation by Jiangyin Yuefa of the production, sale, and offer for sale of the machinery found to infringe Biancalani’s patents
- Payment of compensation in the total amount of RMB 2,000,000
- Reimbursement of litigation costs
The decision confirms the infringement of the following patents:
- Chinese Patent No. 202080041680.5, “Continuous Open-Width Fabric Washing Machine and Method”
- Chinese Patent No. 202080006246.3, “Machine and Method for Continuous Open-Width Washing of Fabrics”
Biancalani appreciates the work of the Wuxi court in promptly identifying the infringement and issuing its decision.
Court Orders Production and Sales to Stop
It is important to note that this is a first-instance judgment, and the defendant retains the right to appeal. The case may therefore continue in subsequent proceedings.
